1. Introduction

This privacy policy is of “The AI Book Company B.V.”, “we”, “us” or “our” trading under the name 'The AI-Book Company' and is located at Koningin Wilhelminaplein 1 in (1062 HG) Amsterdam, Chamber of Commerce register code 96604549.

We offer services on behalf of the Publisher on the basis of which we use artificial intelligence to convert a (manuscript of a) digital book into an 'AI book', which then enables you as an end user to communicate with that book via a chat service, such as WhatsApp. We ensure that you have access to use the AI ​​Book after you have purchased it.

This policy is part of the Terms of Use and therefore applies to the use of our services. By using this you accept the terms of this policy.

2. Definitions

This privacy policy uses the following definitions, regardless of whether they are used in the singular or in the plural:

GDPR: General Data Protection Regulation (EU) 2016/679

AI Book: an interactive version of a digital book based on artificial intelligence, which enables the End User to communicate with that book by asking questions via a Chat Service and receiving answers;

Chat service: the most recent version of WhatsApp or another online messaging service prescribed by the Publisher;

Services: the services to be provided by The AI ​​Book Company on behalf of the Publisher, consisting of the production of the AI ​​Book, and the settlement of the purchase by and delivery to the End User.

End User: a natural person who has concluded a purchase agreement with the Publisher in connection with the purchase of an AI Book; 

Terms of Use: the conditions that apply to the purchase and use of an AI Book by End Users;

Publisher: the publisher of the physical book and/or e-book and owner of the exploitation rights of the work;

Work: a book stored in digital format that is published by the Publisher;

 

3. Who is responsible for the processing of your personal data?

You purchase the AI ​​Book through The AI ​​Book Company. On behalf of the Publisher, we edit a manuscript into an AI Book and facilitate its purchase and delivery to you. To this end, we must process some of your personal data. For this reason, we are a “data controller” within the meaning of Article 4(7) GDPR.

For the editing and development as well as for the sale and provision of the AI ​​Book, we are regarded together with the Publisher as 'joint controller' within the meaning of Article 26 GDPR.

We and the Publisher from whom you purchased the AI ​​Book jointly determine the purpose and means of these processing operations in order to ultimately give you access to the use of the AI ​​Book.

 

4. When does this policy apply?

 This privacy policy applies to all personal data that we process from you as an End User in order to gain access to the Services or the AI ​​Book you have purchased.

We would like to emphasize that we process your personal data in accordance with this privacy policy and applicable data protection laws, in particular the GDPR.

 

5. What are personal data?

This is data that can be traced back to you as an individual. In this case, your name, telephone number, email address and payment details are required to grant you access and use of the Services. But data such as an IP address, a customer number or other data that are unique to you, such as surfing behavior, can also be personal data.

 

6. Who processes your personal data, for what purpose and for how long?

We process your personal data in order to give you access to and use the Services. We process the following personal data:

• Name

• Email address(es)

• Phone number

• Your payment details

• The (personal) information that you share with the Chat Service.  Think carefully before sharing (sensitive) information with us, such as certain medical information about a specific person.  The messages you exchange with the AI ​​book (chat service based on a large language model) are encrypted via the Chat service and not accessible to us. We will only use the (generic) data you generate in accordance with the purposes and principles described in the privacy policy, and only use it to improve our Services.

 The processing of your personal data is based on the following bases within the meaning of Article 6 GDPR:

 a) The execution of an agreement to which you as an End User are a party, namely the provision of the Services, in the context of which you gain access to the AI ​​Book after you have purchased it through the Publisher.

b) The legitimate interest to provide, improve, develop and optimize these Services. A careful consideration has been made in advance between your privacy and the interests of The AI-Book Company. We have come to the conclusion that your interest in this does not outweigh our interest, partly in view of the technical and organizational security measures we have taken (see article 10).

c) We may also process your personal data on the basis of our legitimate interest, such as for marketing, statistical and tax purposes. We want to continuously improve our website, products and services and enable users to use them easily. For example, we collect and use technical data to analyze the use of our website, products and services and to increase the functionality and ease of use, and to better tailor them to the needs of our users. Therefore we can: 

• Send marketing messages via email or chat services to those who have registered and/or purchased or subscribed to an AI book. For example, marketing messages may include information about our Service, service updates, promotional offers as well as other news and blog articles. You can choose to stop receiving marketing communications by email and unsubscribe from our mailing list at any time;

• customize, measure and improve our Service, content and advertising. We can send offers based on your preferences;

• Use cookies or other similar techniques for statistical purposes, to generate anonymous summary statistics that enable us to understand how our users use our website, products and services and to increase user-friendliness.

7. How long will your data be stored?

We store your personal data for as long as necessary to use and provide our services. We will then delete or anonymize your personal data, unless the law or the rights or obligations of either party require a longer retention period.

 

8. With whom is your data shared?

We have concluded a 'joint responsibility agreement' within the meaning of Article 26 GDPR with the publisher of the AI ​​Book you purchased. However, we are not responsible and liable for the (further) processing of your (personal) data. We therefore recommend that you consult the Publisher's privacy policy yourself.

1. We may also use the services of third parties to provide our services. These parties act as processors of The AI-Book Company. We ensure that these parties provide sufficient guarantees with regard to the technical and organizational security measures and conclude a processing agreement with them. Parties that act as processors are:

1. Microsoft Azure as hosting provider for the 'Large Language Models' required in connection with the production of the AI ​​Book.

2. Cloudflare for the security of our services.

3. Neon Postgresql database (EU hosted) for storage of login credentials.

4. Stripe Payment Europe for processing the financial transaction.

This privacy policy does not apply to third-party websites and services that are connected to us via (possible) links and/or otherwise. We cannot guarantee that these third parties process your personal data in a reliable or secure manner. We recommend that you consult the privacy policy of these parties yourself.

 

9. What rights can you exercise?

You have the right to access personal data that we store about you. If you believe that the personal data we hold is incorrect or incomplete, you have the right to request us to correct it and in some cases limit or delete it.

In addition, you have the right to object to certain processing, such as in the case of direct marketing or profiling.

Finally, you have the right to data portability, i.e. the right to receive your personal data in a structured, commonly used machine-readable format and to transmit your personal data to another controller. 

Complaint

If you believe there is a problem with the way we handle your personal data, you can file a complaint with our contact person at privacy@theaibookcompany.com and you have the right to file a complaint with the Dutch Data Protection Authority (www.autoriteitpersoonsgegevens.nl).

 

10. Security

We maintain good security and have taken technological and organizational measures to protect your personal data against loss, destruction, misuse and unauthorized access or disclosure. For example, we limit access to this information to authorized employees and third parties who need to know this information in order to manage, develop or improve our services. Payment information via Stripe is encrypted via SSL. In addition, there is a processing agreement that is part of the agreed agreements with Stripe. The personal information you share with us via Chat Service is encrypted via TLS. The information within the Chat service is end-to-end (E2EE) encrypted.

Although we strive to ensure good security for the data we process and maintain, it is important that you are aware that no security system can prevent all possible security breaches.

11. Changes

We reserve the right to change and update this privacy policy.  We recommend that you consult this page regularly so that you are aware of any changes.
